Terms & Conditions for Advertising Rental Properties

Content of Advertisements

1. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management accepts advertisements in good faith and expects that advertisers will provide an accurate description of their property.

2. All advertisements should comply with relevant UK legislation including the Trade Descriptions Act 1968 (which covers false descriptions) and the Consumer Protection Act 1987 (which covers misleading prices). The advertiser agrees to indemnify Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management against all claims/costs arising out of any misleading information in the advertisement.

3. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will take every care to reproduce faithfully the text, prices, contact details and photographs provided to us by advertisers. We will not however be held liable for any loss arising out of any error or omission on our part.

4. Cubana Holiday Homes Pvt Ltd t/s Eclipse Property Management reserves the right to determine the design and layout of advertisements, and (at our discretion) make alterations to submitted text or photographs, should we consider any to be necessary. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will not be held liable for any loss arising out of such alterations.

Materials and Photographs

5. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will take the utmost care of all materials and photographs provided for the preparation of advertisements, but cannot be held liable for any loss or damage however caused.

Copyright

6. It is the responsibility of the advertiser to ensure they have the right to reproduce any photographs or digital images which they supply to us. The advertiser agrees to indemnify Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management against all claims/costs arising out of any infringement of copyright for such photographs or images.

7. All digital images produced by Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management from photographs supplied by advertisers are the property of Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management, and shall not be reproduced without our permission.

Liability

8. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management cannot be held liable for any loss or damages howsoever incurred, including consequential losses such as lost income, in connection with advertising on the www.cubanaholidays.com and/or www.eclipsepm.com websites.

9. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management hold no responsibility for extra energy charges incurred during airing of a property due to switch on of fans and AC, nor any additional water costs incurred furing the flushing of toilets and running of taps.

Refusal, Termination or Withdrawal of Advertising

10. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management reserves the absolute right to refuse to accept any advertisement submitted. If the advertisement has been paid for on-line a full refund will be made, or if a cheque has been received by post this will be returned. Any materials submitted by post will be returned. Under no circumstances will any compensation be payable by Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management for any loss howsoever incurred, including loss of income, the time/cost involved in submitting the advertisement etc.

11. If Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management receives a complaint about a property, we reserve the right to remove that property from our web site without notice, if in our opinion the complaint is reasonably substantiated. Such complaints could relate to the accuracy of an advertisement, the condition or maintenance of the property, unacceptable booking conditions or procedures, lack of adequate response to complaints etc. In all cases our decision will be final. A refund will normally be made pro-rata for the remaining unused period of the advertisement, however under no circumstances will any compensation be payable by Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management for any loss howsoever incurred, including loss of income, re-advertising costs etc.

12. The advertiser may choose to withdraw their advertisement from the www.cubanaholidays.com and/or www.eclipsepm.com websites at any time – please notify us in writing (letter or e-mail). On this basis, the advertiser will not receive a refund. They may also request that that their advertisement is reinstated at any time during the period of advertising purchased. Please note that the period of advertising will not be extended to allow for the time when the advertisement was not showing on the web site.

Level of Service

13. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will endeavour to approve new advertisements, and approve changes to existing advertisements as quickly as we possibly can. However, as we have no control over the number of requests that we receive at any time, we are unable to guarantee response times.

14. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will endeavour as far as practical to ensure that the website is available on the internet at all times. However some breaks in service are inevitable and often beyond our control, we are therefore unable to guarantee 100% availability.

Payments

15. Payment for advertising and other services must be in British Pounds or Indian Rupees by bank transfer or credit card. The advertiser will pay any costs incurred of making such bank transfers. Credit card payments attract an additional administration fee of 3.5%.

16. Payments for rentals will be forwarded to the owner on a monthly basis minus any fees applicable.

17. Invoice payments made to Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management are strictly 5 days from the invoice date. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management reserves the right to charge interest of 15% per month in the event of late payment. Any legal and/or administrative costs incurred by Cubana Holiday Homes Pvt Ldt t/a Eclipse Property Management as a result of recovering overdue payments will be charged to the customer.

18. Cleaning equipment must be provided by each villa for adequate cleaning service to be provided.  If equipment needs to be replaced or detergents require topping up, Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will inform the customer before purchasing anything on their behalf.  If the customer agrees, items will be purchased and invoiced accordingly.

19. Maintenance will be carried out at invoice rate plus 20%.  Customers will be informed of problems and provided with a quote.  If accepted by the customer payment of monies for materials will be required BEFORE any work is carried out.  The balance will also be required on adequate completion of the work.  These invoices will be outside the normal billing period to ensure all costs of maintenance are covered accordingly.  Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will make every effort to ensure skilled workers are used. Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management will not be held responsible for faults arising from maintenance work carried out by independent contractors or unsatisfactory workmanship.  All claims for refunds will be made to the contractor completing the work and not Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management.

20. Utility bills will be paid at the rate of bill plus admin cost.

21. Changes to the above and pricing can be made at any time.

22. All above terms & conditions are in addition to those agreed between the owner(s) and Cubana Holiday Homes Pvt Ltd t/a Eclipse Property Management in their individual Collaboration Agreements.
